CA Crim Appeals bro here. His appeal was orally argued 2 months ago, and decision is due in 90 days, i.e., by late September. He's got no chance.
He's also filed a habeas petition alleging IAC, which I'm sure will also be dead on arrival.
The Church of Scientology filed an amicus brief and a bunch of other shitpaper in his appeal, which is funny. As if the Court of Appeal cares what they have to say.

I've done a number of appeals of these cold case he said / she said sex crimes where the guy is convicted after a hung jury in the first trial. It's totally rigged every time. IMHO a hung jury should require a dismissal with prejudice. I don't think it's fair that the DA gets a second bite at the apple if they fail to get a unanimous verdict, where they can improve their trial strategy and know what the defense strategy is. They should have one chance to shoot their shot.

The retrial of Danny Masterson differed from the first trial in several significant evidentiary respects. Judge Charlaine Olmedo reconsidered several of her own earlier rulings after the first jury deadlocked, allowing the prosecution to present a broader case.
The major pieces of evidence and testimony that were newly allowed were:
The prosecution was allowed to explicitly argue that Masterson drugged the women. This was probably the single biggest change.
First trial (2022): The women could testify that they suddenly became dizzy, disoriented, blacked out, or lost memory, but prosecutors could not directly argue that Masterson had drugged them.
Retrial (2023): Judge Olmedo allowed prosecutors to state outright that the evidence showed Masterson had drugged the victims before assaulting them, despite there being no toxicology evidence because the allegations dated back roughly twenty years. The prosecution argued that the women's symptoms were consistent with incapacitating drugs such as GHB.
Expert testimony on Scientology was admitted.
First trial: The judge excluded expert testimony explaining Scientology's internal disciplinary system and why members might delay reporting crimes.
Retrial: Former Scientology executive Claire Headley was permitted to testify as an expert about Scientology policies, including testimony that members were discouraged from reporting fellow Scientologists to law enforcement and that internal church procedures could influence victims' behavior after an alleged assault. This was intended to explain why the accusers waited years before contacting police.
A different prior-acts witness testified.
California Evidence Code §1108 permits testimony from other alleged sexual assault victims to show a propensity for sexual offenses.
First trial: The prosecution called Tricia V.
Retrial: Instead, prosecutors called Kathleen Jenkins, a Canadian woman who alleged Masterson had drugged and raped her in 2000. Judge Olmedo allowed this testimony even though it had not been presented in the first trial.
These were the principal additions. The underlying testimony of the three charged accusers remained largely the same, but the prosecution's theory became substantially more forceful because it could:
explicitly characterize the incidents as involving drugging,
present expert context about Scientology to explain delayed reporting, and
introduce a different uncharged sexual assault witness whose allegations also involved alleged drugging.
Those changes became central issues in Masterson's subsequent appeal, with his attorneys arguing that the expanded evidence unfairly prejudiced the jury and should not have been admitted.

I didn't say it's unfair or that he wasn't railroaded. He should have copped a plea, fully expecting that he'd get unfairly railroaded and knowing that he would face a mandatory sentence of 30 to life serving 85% of it.

It was crazy how first trial ended in mistrial and then in the second trial the judge allowed a shitload of biased evidence against him and took away any chance at defending himself. Also the two bitches had 20 years to corroborate their stories. So juries hear it identically from the women, no defense is presented. You have to convict. It was a ridiculous hit job especially the bitch judge was a total insider for the regime. It wasn't fair at all.
That being said I literally believe he violently raped two women so 🤷
