I didn't think about that angle as well, but given that male drivers currently earn significantly more than female drivers, I think that case is harder to argue. But it will be interesting. My understanding is that the reason that male drivers earn more is because the best time to drive for Uber is when the bars close, and female drivers don't want to let a bunch of drunk randos into their cars. If female drivers suddenly start earning significantly more than their male counterparts once this change goes into effect, the male drivers might have a case. I'm not a constitutional lawyer, but my understanding is that gender-based laws get intermediate scrutiny rather than strict scrutiny for laws based on race.
