It's a great (((scam))) because the refund money is effectively guaranteed. I think the only way the lender could get fucked is if after acceptance the return gets flagged for an audit and the refund isn't as big as anticipated. Possibly also if the taxpayer gets the refund and then immediately files bankruptcy, I'm not sure if the bankruptcy trustee or the (((bank))) would get it.
