I mean suppose the 14th amendment were held not to prohibit this kind of discrimination, or to even call it "discrimination" at all. I would argue that any state law or constitutional provision that prohibits such discrimination infringes on my freedom of association. What means of association is more American than selling hot dogs and lemonade and why is Minnesota telling me how not to do it?
