in general, though, the question of whether something is in the scope does not turn on whether policy was violated.

that's the entire point, and the power, of absolute immunity. there is no need to decide whether a judge or legislator who is following policy should get immunity.

the entire issue arises when a judge or legislator is doing their job and massively errs.

i'm not sure you and i are focusing on the key issue.

absolute immunity becomes an issue when someone arguably fucks up. it doesn't become an issue when someone follows policy.

so if a judge makes a massively erroneous ruling but wasn't bribed, etc., then it was within the scope of the job but was outside policy -- and the judge gets absolute immunity.

qualified immunity is more common, but even there it is broadly applied. cons have wanted to trim back or even decimate QI but libs have opposed that.
