If the 5th Circuit decides otherwise they'll find a procedural fault and remand with instructions over and over until they have to confront the question, at which point they'll decide that the historical authorities differ too much and there's too many reliance interests and administrability concerns and so they'll reverse in full. This will take 20 years, on top of the 30 other years that have already been sunk into this Quixotic dream, and you and Kris Kobach will have endured the worst case of blue balls in history for nothing. I suppose you could have some separate process, where we create an agency tasked with registering citizenship for new babbies, but this would be a huge undertaking -- you'd need new offices in thousands of cities and towns, and probably at least half of proles would never bother with taking their babby to register him/her/they. |
