I’ve gotten used to working with good lawyers. I’m working on this other case with mediocre lawyers fighting over $300k and they are struggling to learn anything. This one lawyer is literally just asking the witness to read the documents. They have not established authenticity or admitted any of them.

Q: Now, I am showing you what was previously marked as Plaintiff's Exhibit 478. It is a series of emails printed from newest to oldest beginning with an email from the defendant to a series of people. At some point in the string you are added as a "cc." In that original email the defendant refers to the plaintiff as a "potential buyer." Do you have any idea why the defendant referred to plaintiff as a potential buyer?

A: I have no recollection of this email and I have no idea why the defendant wrote what he wrote.

back in the day, i saw a depo where the defending lawyer said after nearly every question: "Objection calls for witness speculation. You may answer if your answer is not speculative." he must have said that 200+ times in the depo and always in a nasty tone of voice.

in response, the witness said he could only speculate about things like what job he had, what his job responsibilities were, etc.

the depo was video taped. when the judge finally got a hold of the issue she tore the lawyer a new asshole in front of dozens of lawyers at the law-and-motion calendar. unfortunately that sort of just deserts doesn't happen often.

im a mediocre AF lawyer, but AI (especially westlaw co counsel) has evened the playing field for me a little bit. I am definitely trying to learn more litigation shit as a counter to the AI threat (which will probably impact some of my transactional work one day)

My theory is that AI will impact litigation way more than commercial practice compared to what people expect.

Commercial law as a business model is still primarily based on human relationships with rainmakers as the load bearing equity holders. Litigation is more of a race to the bottom

We’re a third party and they didn’t ask for a business records affidavit in the subpoena. They’re retarded.

Not to mention a lot of these are text messages copy pasted into a word doc. Good lawyers would authenticate out of habit.
