i still can't find a link to the actual Q and A. the news accounts say it was a denial that he used anyone to leak.
but we did learn that Comey had his friend Richman leak to the NYT.
if that's the theory of prosecution i don't see what's wrong with it.

Senator Cruz: (01:51:30) [Comments about FISA matters.] All right. Let's shift to another topic. On May 3rd, 2017, in this committee, Chairman Grassley asked you point blank, "Have you ever been an anonymous source in news reports about matters relating to the Trump investigation or the Clinton investigation?" You responded under oath, "Never." He then asked you, "Have you ever authorized someone else at the FBI to be an anonymous source in news reports about the Trump investigation or the Clinton administration?" You responded again under oath, "No." Now, as you know, Mr. McCabe, who works for you, has publicly and repeatedly stated that he leaked information to the Wall Street Journal and that you were directly aware of it and that you directly authorized it. Now, what Mr. McCabe is saying and what you testified to this committee cannot both be true. One or the other is false. Who's telling the truth?
Mr. Comey: (01:52:43) I can only speak to my testimony. I stand by the testimony you summarized that I gave in May of 2017.
Senator Cruz: (01:52:50) So your testimony is you've never authorized anyone to leak? And Mr. McCabe, if he says contrary, is not telling the truth, is that correct?
Mr. Comey: (01:52:58) Again, I'm not going to characterize Andy's testimony, but mine is the same today.

Even bigger problem is that a Grand Jury REFUSED to return an indictment against McCabe.
So how are you going to convict Comey based upon the "truth" of McCabe's statement when a Grand Jury didn't believe he committed a crime?
LOL!

doesn't that bolster McCabe?
it's not the leak that is the basis of the new indictment; it's the alleged lying about it. it's a process crime.

WHAT CRIME WAS COMMITTED!?!
McCabe said that he spoke with Comey THE DAY AFTER the article came out and told Comey that he (McCabe) authorized the disclosure.
So when did McCabe ever say, "Yes, Comey authorized me to leak the information."

"Comey, in his September 2020 testimony, told Sen. Ted Cruz, R-Texas, that he stood by prior testimony that he did not, as FBI director, authorize a leak of information to The Wall Street Journal for an October 2016 article that detailed a Justice Department probe of then-Democratic presidential nominee Hillary Clinton’s email use.
Cruz told the Justice Department in a letter three months later that former FBI Deputy Director Andrew McCabe admitted knowing about and authorizing the leak.
McCabe insisted that Comey was aware of his decision to authorize the disclosure, while Comey “has denied this claim,” Cruz wrote.
“Mr. Comey and Mr. McCabe’s statements are irreconcilably contradictory,” Cruz wrote. “Mr. McCabe says that he told Mr. Comey of the leak and that Mr. Comey approved — effectively authorizing the leak after the fact. Mr. Comey, on the other hand, has said that he neither authorized the leak nor knew of Mr. McCabe’s involvement.”

AT THE BEST, the Govt's argument is gonna be:
"Look, McCabe is telling the truth when he said the told Comey BEFORE the leak, and Comey gave implicit approval of it!"
The problem is that in that same investigation the DoJ's Inspector General said that McCabe "he lacked candor about an episode involving the release of information to a reporter."
https://www.npr.org/2020/02/14/806052193/former-fbi-official-andrew-mccabe-wont-face-charges
So McCabe was telling the truth when he "lacked candor" and that is the basis for proving Comey was lying?

What was your reading comp score?
The compelling argument is,
"You have no proof that Comey knew about the leak BEFORE the article was published. More importantly, you can't prove that Comey AUTHORIZED the disclosure. So how are you going to prove that Comey lied in 2020 when Cruz questioned him?"

Both can actually be true.
Comey: I didn't know about the leak until after I saw the article was published and McCabe told me that he authorized the disclosure.
McCabe: Comey didn't know about the disclosure until after the article came out and I spoke with him the day after. He didn't really seem upset about it.

No he didn't.
McCabe never said that Comey authorized or even KNEW about the leak prior to the article being published.
If the DOJ had such testimony in their backpocket, they wouldn't have waited 5-fucking-years to bring an indictment.

To be fair,
Libs: "This is a stupid nothing crime... political persecution!!!"
Weird how the very same people angrily shouting this from the rooftops now were openly sneering at this very same line just a few years ago, when precisely these sort of "gotcha" technicality crimes were being used to throw Trump officials and allies in prison as "felons."
Very strange... but I'm sure it was all totally different (and also totally OK) back then, for principled and legitimate reasons of course, haha yeah haha...

To be fair,
Link to me saying Comey's guilty of committing a crime? AFAIK, everyone is innocent until proven guilty in a court of law (except for BLONDALF "HITLER" DRUMPFTH, of course), and at this point he's only been indicted, IMO.
Weird that you won't just answer this simple question, though. I said I would go right after you went, and I'm asking because all of these years later I'm still extremely confused about the theory of the case there and you seem like a really smart and legally sophisticated guy who could finally help clarify that for me. You scratch my back, etc.

Ok, let me hold your hand while I walk you through this:
- The indictment alleges that Comey lied to Congress in 2020 when he told Cruz that he didn't authorize the leak.
- The leak was McCabe releasing information to a reporter about the Clinton investigation in 2016.
- Comey said he didn't even know about the leak until AFTER the article was published and he spoke with McCabe. . .again, AFTER the article was already published.
- There is no evidence that Comey authorized anybody to disclose the information.
- The statute of limitations was set to expire in less than a week and NUMEROUS career federal prosecutors refused to bring this bullshit case.

i support the indictment -- comey very recently posted on social media "86 69", calling for trump's assassination, and he wrote in his book that he wished he rigged 2016 more, which he would have if the polls were closer. he's a globohomo piece of human filth & its perhaps the upper level elites are cutting him loose because he's an expendable goyim
at the same time, DC voted 95% for hillary in 2016 so the odds of conviction are extremely low even if the prosecution was slam dunk (and pam bodhi is retarded)

this is bullshit, and all of the trump charges were bullshit. none of this should be happening, but i'm not going to criticize trump's doj for doing this. it's not like they charged trump with a single bullshit crime and he got off and it ended, they went after him using the criminal courts for years and failed.
so i have zero sympathy for comey or anyone else who gets hit with charges that are a total reach. the deep state/dems opened this door.
hopefully it stops after drumpfgh leaves office, but we'll see what unfolds.

i don't disagee strongly with this. however i think the bar for indicting officials for acts while in office should be very high. we understood this under nixon and clinton. the appearance of political prosecutions is dangerous.
i wish trump would have made a speech talking about how they could have indicted comey or pardon him now, and say that although he is guilty, we cannot continue down the path to a banana republic. that would give us the clear moral highground over the libs. this just paves the way for more tit-for-tat prosecutions, even though i agree that the “tat” here is far more justified than trumps completely invented crimes.

my concern is that this makes it more likely it wont.
the country is so bitterly divided and deadlocked. id like to see the GOP extend one final olive branch before we go full on acceleration. but maybe were already past that. i definitely dont see this ending with trump and this gives libs a rhetorical casus belli to justify more trumpian charges.

i also think comey is going to get off on some sort of “it depends what your definition of is is.” i doubt he explictly said “i authorize you to leak this information.” he probably passed it along, made an exaggerated wink, and said “boy it sure would be bad for trump if this information got out!”
