In fact no one has been able to explain why this regulatory prohibition even existed in the first place. It's not clear that it was mandated by the law FDA cited (which was passed in 2009). If anything the law seems to contemplate that such restrictions would be lifted during a public health emergency, but FDA claimed that it was *triggered by* the emergency. And the regulation establishing the prohibition was never even promulgated through notice and comment rulemaking, so the notion that FDA had to go through any sort of formal rulemaking process to lift it seems suspect. This either one of the most egregious bureaucratic snafus in US history, with agency lawyers (among others) fumbling the ball for weeks, or the process was deliberately slow-walked.
