The Review Process
Every person who is a candidate for admission to the bar of this state based upon taking and successfully passing the New York State Bar Examination (see 22 NYCRR 520.2), or for reciprocal admission on motion based, inter alia, upon admission to practice before the court of last resort in another state, territory, or the District of Columbia (see 22 NYCRR 520.10), and every person seeking licensure as a legal consultant (see 22 NYCRR parts 521, 692), must undergo an investigation of her or his character and fitness. The process requires the candidate to complete an application questionnaire, to complete or secure the completion of several additional forms, to submit required documentation, and to appear for a personal interview before a member of the Committees on Character and Fitness.

All individuals who pass the New York State bar examination and the M.P.R.E., as well as those seeking admission on motion (from reciprocal jurisdictions), and foreign attorneys seeking to be licensed as foreign legal consultants in the First Judicial Department, must pass through an application process administered by the First Department’s Committee on Character and Fitness (“the Committee”).

APPLICATION FOR ADMISSION/CHARACTER AND FITNESS INVESTIGATION - Shortly after the bar examination, the Board sends to the Supreme Court, Appellate Division in each of the four judicial departments, a list containing the names and addresses of the applicants from that department who took the examination. Each department then sends information regarding the admission application to each applicant on its list in order to expedite the admission process by permitting the applicants to complete and file the forms prior to receipt of the results of the examination. The forms must be filed within three years of the date of the Board's initial letter notifying the applicant of successful completion of the bar examination. These forms, which are the same for all four departments, serve as the basis for inquiry by the Committees on Character and Fitness into the applicant's character and fitness to be members of the Bar.
