Not trying to make a political point here.

I spent years as a mortgage banker at Quicken Loans (now Rocket Mortgage), the number one mortgage lender in the country, before I ever went to law school. So when I see stories like this, I look at them a little differently.

Here’s the deal. How you classify a property as a primary, secondary, or investment home changes everything about the loan. The down payment, the interest rate, the underwriting, all of it.

Primary or secondary homes can get by with as little as 3 to 10 percent down.

Investment properties usually require 25 percent or more.

So if you’re a brand new real estate investor with limited cash, there’s a big incentive to call something a “second home” instead of an “investment property.”

But that’s why lenders make you sign a Second Home Rider, a separate document where you specifically promise you’ll use it as a second residence, not rent it out.

You also assert like NINE times in the application process it will be owner occupied…

Could this kind of thing ever be an honest mistake? I doubt it.

The facts, at least as reported, look pretty bad.

You buy a house, say it’s a second home, immediately rent it out, tell your insurer it’s owner-occupied, and then report rental income on your taxes.

That’s not a misunderstanding. That’s a pattern.

By the way guys, taking home owners insurance under the misrepresentation that it’s a primary for better rates is a great way to have a claim denied when your house burns down.

Very shortsighted mistake that many make...

Would a bank ever catch this on their own? Probably not.

Banks rarely dig that deep unless there’s a default or an insurance claim.

They just don’t have the infrastructure or frankly the desire to chase it down.

So yes, it’s definitely selective prosecution.

The amount of money at issue is small, and most people would never be charged for something like this.

But still, if the facts are accurate, it’s just a series of really bad moves.

And the wild part is that she’s a lawyer.

She’s the Attorney General of New York.

She’s prosecuted the former president for similar financial misrepresentations.

You’d think someone with that background would fully understand what those documents say and what it means to misstate intent on a loan.

It’s going to be a tough case for her to defend, unless she’s able to present additional information that clarifies the situation.

It’s possible…

In the meantime, there are lots of financial and life lessons in this story for all of us.

Anyone surprised by the news that former special counsel Jack Smith collected the private phone records of eight Republican senators as part of his investigation into President Donald Trump was not paying attention to the prosecutor’s hardball methods. Many Democrats still cannot see how their legal aggression against Trump during his four years out of power set the stage for the dangerous revenge tour on which he is now embarked.

This week, Sen. Chuck Grassley (R-Iowa) published an FBI document from September 2023 showing that the bureau analyzed phone data from senators, including Lindsey Graham (R-South Carolina), Ron Johnson (R-Wisconsin) and Marsha Blackburn (R-Tennessee). The search covered Jan. 4, 2021, to Jan. 7, 2021 — the days around the Jan. 6 Capitol riot.

The revelation struck a chord on the right because official communications of legislators are not supposed to be seized by the executive except in extraordinary circumstances. The framers codified that principle in the Constitution’s speech or debate clause, which protects Congress’s independence by creating a zone of immunity around legislative communications.

But who thought prosecutors in the Biden administration would tread carefully in this area when dealing with Trump allies? The FBI made no secret of seizing the phone of Rep. Scott Perry (R-Pennsylvania) in 2022. The congressman invoked the speech or debate clause, but prosecutors said it did not apply. They were rebuked by an appeals court, which in 2023 limited the scope of Perry’s communications the Justice Department could access.

The targeting of senators that Grassley revealed appears far less invasive than Perry’s case. It’s not a mystery why prosecutors wanted phone logs. Trump tried fruitlessly to convince lawmakers to vote against recognizing his election defeat. Biden’s Justice Department presumably thought members’ communications could give it more evidence against him.

But the mere fact that a legal tool might be available does not mean it should be used. The current rage over Grassley’s revelation shows why. Smith showed little restraint in his pursuit of a former president. He charged Trump for official acts he took as president. He sought a gag order to limit Trump’s ability to criticize the prosecution. He tried to accelerate the case to try a leading presidential candidate before the 2024 election.

Trump is showing still less restraint as he steamrolls his own Justice Department to demand the prosecution of enemies. Former FBI Director James Comey, the first target, was arraigned on Wednesday in federal court in Northern Virginia and pleaded not guilty. Comey is charged with misleading Congress during 2020 testimony relating to the 2016 election. The case always sounded like a stretch, but as more information emerges, it looks pathetically weak.

Most people don’t like what’s going on. A Pew Research Center poll published Wednesday shows that 62 percent of Americans believe Trump has definitely or probably used his office improperly to encourage federal investigations of his political opponents, including 40 percent of Republicans.

Some Trump allies rationalize what’s happening by saying that they can escalate to deescalate — that is, respond to the legal attacks on Trump with wilder legal attacks on his enemies, thus deterring conflict in the future. But the country is nowhere near the top of the escalation ladder. Republicans are naïve if they’re confident they can deliver the final blow or that Trump can stop the cycle with blanket preemptive pardons come January 2029.

It might feel satisfying for some people to watch their opponents get perp walked, but what goes around often comes around. A spiral of four-year revenge cycles is a recipe for the decline of a republic. Good people will be deterred from public service if they see a meaningful risk of winding up in jail afterward. Lawfare, like warfare, has unpredictable logic. Total victory is impossible in such a divided country. Eventually, one or both sides will need to start negotiating the terms of a legal peace.

Exposed: Letitia James’s Decades of Alleged Mortgage Fraud

After four years of relentless lawfare against President Trump, with Democrats shouting that “no one is above the law,” they’ve made one thing perfectly clear: in their world, Democrats are above the law. The evidence that New York Attorney General Letitia James engaged in mortgage fraud is extensive and damning, yet Democrats react with outrage, accusing Trump of “targeting his enemies,” with zero self-awareness or irony.

Make no mistake—unlike James’s baseless case against Trump, the proof that James herself broke the law is overwhelming. Conservative filmmaker and journalist Joel Gilbert laid out a detailed and troubling case, showing that her alleged pattern of mortgage fraud spans decades, and is far more serious than her defenders admit.

Speaking on Real America’s Voice, Gilbert made a detailed James’s extensive history of mortgage fraud.

“Letitia James probably should not have been charging Donald Trump with trumped-up charges of mortgage fraud in New York, given the fact that New York is a public record state and that all of her mortgages for 43 years were online for myself or anybody else to pull up,” Gilbert said. He then outlined a pattern of alleged mortgage fraud dating back to 1983, when James was just 24 years old. “She purchased her first home with her father, claiming that her father was her husband,” he said. “They purchased it as husband and wife in order to help Letitia qualify for a mortgage that she was not entitled to.”

The filmmaker said James continued this pattern with her Brooklyn property. “She bought a four-story, five-unit apartment building, and for 24 years she told the banks it was either four units or one unit, even though the certificate of occupancy for the building said it was five units,” Gilbert explained. He noted that the distinction mattered, because “if you have four units or less, you get a residential mortgage rate, which is lower. You also get almost no closing costs. Five units or higher, like Letitia had, you get high interest rates and very high closing costs.”

And there’s more.

“She also didn’t register for rent stabilization, which she was supposed to do every year.” As Gilbert put it, “her building is a crime scene, and she defrauded and scammed banks for 24 years” to save money “she wasn’t entitled to.”

James also engaged in mortgage fraud with three homes in Virginia. “Every one of those three homes, there’s mortgage fraud. She buys a foreclosure with her aunt, and then she doesn’t appear on the deed, which is illegal,” Gilbert said.

He described one property on Sterling Avenue in Norfolk, Virginia, in particular: “She explicitly says, ‘I bought this for my niece’s children,’ to make us think that, oh, she, she’s trying to help little kids. Well, her niece’s two children are adult convicted felons. One of them is an absconder from justice with an arrest warrant out of North Carolina. So Letitia bought the property specifically to harbor a fugitive.”

Gilbert also explained how James misrepresented her occupancy to get favorable mortgage terms. “My colleague Sam Antar pointed out that Letitia claimed that would be her primary residence. It was actually rejected by the bank nine times. The tenth time, Letitia says, ‘That’s gonna be my primary residence.’ It gets approved, and that was illegal ‘cause she got the mortgage and lower interest rates because she’d be the primary resident.”

It’s the third Virginia property that triggered the first major legal action against James, as she allegedly rented it out despite a loan requiring her to occupy it or treat it as a second residence—an apparent case of bank fraud carrying up to 30 years in prison. He warned this indictment may be only the beginning, noting James’s alleged pattern of mortgage fraud spans 24 years, including as recently as 2021. Gilbert concluded that James has “repeatedly gamed the system, defrauded banks, and misrepresented herself on property transactions for decades,” all while pursuing politically motivated cases against others.

Something tells me that her problems are about to get worse.

Unless you think Halligan and Bondi are going to willingly get themselves disbarred for Trump by either (a) perjuring themselves, or (b) testifying truthfully that these were indeed vindictive prosecutions. Thompson, living rent-free with her three children in the $235,000 property since 2020, is listed as an ‘absconder’ in North Carolina for evading probation after misdemeanor assault and trespassing convictions.

“She faces arrest if located in North Carolina,” said Keith Acree of the North Carolina Department of Corrections, noting the non-extraditable offenses. Thompson told a grand jury James covers the home’s upkeep.
