But if you accept that a "right" can include something outside of the constitution like a statutory right reflecting the majority popular will, then no, their "rights" are not in "jeopardy". The United States is now going through the process of arriving at democratically decided compromises in balancing the right of women to abort and the right of infants not to be aborted that the rest of the Western world went through in the 1960s and 1970s and the U.S. was going through in 1973 until the Supreme Court terminated the right of elected legislatures to decide on the democratically palatable compromise of allowing it up to X weeks and not after X weeks, with each legislature deciding its own X. The State legislatures are now going through this process 50 years after they started, and they will sort it out in the next 5-10 years, based on majority opinion in each State, and then women in all States will have some "rights" up to X weeks. |
