Client is bank rep from EU bank who is interested in financing a client's US RE investment (securing the loan w/ the property he is buying). He asks if they, as a foreign bank, can put a lien on the property and be the first mortgage holder? WHERE would I find the answer to this question?

Not seeking legal advice just some guidance on where to dig. TYIA

I imagine anyone can put a lien on the property whether they are foriegn or not. Ppl sometimes sell their house and give the buyer a second mortgage from their own money and I assume they have a first or second lien on the house once its sold

I agree, but I now have doubt about this seemingly obvious answer ("yes") and why it would be asked by someone that high up the food chain who should know the answer

More interesting question is whether the banks income on the loan will be subject to US taxation via FIRPTA? Does FIRPTA apply to banks or just transferors/transferees?
