She was trying to challenge the Mississippi lawyer's argument that medical technology has evolved since Roe/Casey so viability is not actually a bright line test. Lawmo but kind of dumb so not sure. I thought Daubert is a standard for what kind of expert medical testimony is admissible in tort cases. |

STEWART: I'm sorry. JUSTICE SOTOMAYOR: -- in -- in regular cases, courts decide whether science fits the Daubert standard. Obviously, the -- under the Daubert standard, the minority of people, a -- a gross minority of doctors who believe fetal pain exists before 24, 25 weeks, it's a huge minority and one not well founded in science at all. So I don't see how that really adds anything to the discussion.
I don't know what, if any, discovery was had in the underlying case, but the 'only a minority of doctors' think this argument is the Frye standard, which is not the law in federal courts. Daubert essentially is a falsifiability test. So at best, she's applying the wrong law, and at worst, she is basically testifying from the bench on her understanding of medical science. JFC. |
