Friend was drinking beer in a parking lot prior to a baseball game. Yes, I believe this is called...tailgating. Yes, that may be it.
Anyway, NYPD officers were being NYPD officers and decided to charge him and his buddies with a violation.
Question, does he have to state that on his law school apps?

If this is the only thing he has to disclose, then there is no harm in disclosing it. Better to be upfront about it than have someone accusing you of trying to hide it. It's no big deal. I had a misdemeanor open container citation when I was 21 and it did not have any effect on getting into law school.
As to whether it is a misdemeanor or some other civil violation, it is more than likely a misdemeanor that you'd have to report on most law school apps. I don't know New York's alcohol laws, though, and am not going to bother looking them up.

Hiding a trivial crime is much, much worse than revealing a trivial crime. No one gives two shits about most of this, even MJ or MIP. But you fucking fail to disclose, and that shit's like homicide.

This exact same thing happened to me – the exact. Hell, we might have been at the same game in the same parking lot. Mets or Yankees?
Anyway, it is a violation, NOT A CRIME. The NYPD loves giving these out because they're easy revenue and there are always people drinking in public in NYC. If he sends in the form (my suggestion) and effectively pleads guilty, it'll be sealed with no criminal record and doesn't technically need to be disclosed on most apps. HOWEVER, if the app asks about "violations of the law," then yes, he needs to write an addendum explaining the circumstances. I would suggest he write one anyway to be safe. No admissions committee outside of BYU will hold it against him.
If your friend has the patience to go to court and plead not guilty, there's a chance it'll be thrown out if he acts humble and respectful before the judge. The same disclosure rules apply, though, since most apps ask about charges, not just convictions. Hope this helps.

It is a rather sad thing when enforcement of the law is linked to the funding of the organization enforcing it. This is another example of a statutory thing like speeding tickets that should have no link to a departments funding.
In fact, it would be sweet if we could fine the cops for giving too many of these offenses out. I don't know, cut the departments budget for enforcing the "wrong crimes" I don't know I am thinking out loud. But I am sure there was a couple of rapes and robberies going on these cops should have been enforcing rather then writing this poor sap up for being drunk. Assuming he was even drunk in the first place, what a joke!
And this is coming from a 2L that has never had a single drink! Nazi cops indeed!
