we need the commerce clause to be a general police power so liberals can write really long fucking articles in their fancy schmancy law reviews.

EDIT: I'm not too sure, but wouldn't social security, medicare, most government agencies etc. be unconstitutional under the original meaning? Not that this would necessarily be bad, just wondering

The founders created a method for amending the Constitution. This is preferable to congressional usurpation that gets rubber stamped by judicial fiat.

nah i'd rather live with the rules we make by majority vote. but in any event not clear that the founders were as dumb as you take them to be--of course those debates should be merely academic

if you want to just live by majority rule, why bother having a constitution at all?

the founders definitely contemplated that the constitution would undergo significant change. I just think they expected the change to be done through open, legal, and democratic means rather than backdoor deals and regulatory creep.

You don't understand. The main purpose of the Constitution is not to set a foundation for limited government. The main purpose of the Constitution is that we can use it as a source for dreaming up endless whiny individual rights in order to justify MORE government power, not less.

social security, medicare, and most government agencies are really just spending programs, not regulation of commerce. They don't rely upon the commerce clause for their authority, but rather upon Congress's power to "lay and collect taxes [and spend them] to provide for the general welfare."
