it was ratified 3/4 of the states, but not within the 7 year period for ratification set forth in the amendment itself. the 3/4 hurdle was reached in like 2020 -- decades later. any constitutional scholar says that ratification isn't valid because it wasn't done within the 7 years.

it's an unsettled constitutional question whether you can rescind ratification, SCOTUS would have to rule on that
allowing ratification to be rescinded would probably create some fucked up incentives where a state could ratify and then last second threaten to rescind and start playing weird power games and you end up with some scenario where actors who want it passed play chicken with each other at the last minute
personally i think a state shouldn't be able to undo a ratification, but my basis is practical rather than constitutional (i'm not sure there IS a real constitutional basis one way or the other)

Cons need to target the ABA’s clout over major practice areas. Trump should announce that anyone who speaks on an ABA panel or shows up on a list of attendees at an ABA meeting will not be considered for any appointed position (or will be fired if they currently hold such a position). That’s a distinction without a difference. The ERA didn’t comply with the requirements for ratification. Declaring it ratified anyway is essentially the same as Trump declaring a new amendment to get rid of term limits or whatever.
