HYS -->1 year biglaw -->COA & Dist court in secondary city (e.g., boston, baltimore, atlanta, etc.)

Spent all spring/summer applying to firms and didn't get any bites. Had to go back to my original firm, which I didn't want to do - both because its a miserable place to work and because it's on the wrong coast. I can't lateral immediately, because that looks weird, and by the time I wait a year, I'll be a 5th year, which is starting to get a little too old to lateral.

Got fucked right in the pussy. One.wrong.move.

Why did you do the second clerkship?

You can lateral after 6-12 months back at the firm.

i mean it's not totally a one.wrong.move situation because I am gainfully (albeit unhappily employed), had 2 chill years where I got in excellent shape and fucked lots of women, and got a nice clerkship bonus. But I do think I would have had more options to move around (and especially to move cross-country) had I stayed at my firm and never clerked.

ummm that sounds pretty awesome. a 2 year vacation with guaranteed jerb waiting for you and 4th year salary plus clerkship bonus. wrt to lateraling, not sure how much it makes up for lacking that RIGOROUS BIGLAW LITIGATION EXPERIENCE that 2nd-3rd years have, but i presume you're a good writer at this point (you'd have to be) and it's a solid list of credentials.

clerking was the best year of my life since college, btw. lol at mistake.

You're obviously a shitty applicant. You did 1 year of biglaw, where you developed no useful skills. Then you clerked for 2 years in a market you don't want to work in and hadn't worked in before, and apparently also learned no useful skills (or couldn't communicate them). Now you're applying to biglaw firms who don't know you from Adam and want to show up and take home a 4th year paycheck (plus bonus!) when you act like just another idiot 2nd year. Color me shocked that random firms aren't beating down your door.

I also find it odd that apparently his first year of biglaw makes all the difference. There are lots of two-clerkship (in random markets) people running around, they all get hired as third-years. Maybe they are mostly going back to their original firms.

Summer & start at NYC biglaw

1 year later disappear to Atlanta to clerk

2 years later mass mail west coast biglaw

Of course this strategy doesn't work. Recruiters see somebody without ties or a connection from his clerkship who ran away from his firm after a year, and assume he either got pushed out or can't cut it. Clerkships are a great credential if you leverage them well. Clerking in a random non- coastal market you don't want to practice in as a way to swap east coast biglaw for west coast biglaw is just a terrible strategy.

that's fair. I guess I just don't see it as being *THAT* much different than lots of people I know who did SA in NYC + Flyover Dct + Flyover COA immediately after graduating.

And given that so many judges (everywhere - not just NYC) hire for a year out these days, it just seems like his pattern should be pretty common.

NYC SA --> double flyover --> CA biglaw is still quite a challenge. I don't know why lawyers think they can act like mercenaries, move all over the country and not get dinged as flight risks or drifters. I guarantee you OP didn't summer on the west coast and didn't take a west coast bar prior to applying. Gibson Dunn's LA office really doesn't need a 4th year licensed in NY with local experience in Des Moines and Cleveland. Frankly OP should be thankful his NYC firm took him back AND paid him a bonus.

Edit: I also am not sure the 'mercenary' thing applies to clerkships given how common it is to end up in the middle of nowhere - but I may have also bought into the clerkship bullshit thrown out by my school.
