A. Purpose of Criminal Law
1. Punishment
2. Deterrence (general – the message you send to society in general and
specific – the message you are sending to the specific criminal.)
3. Rehabilitation (out of compassion and of self-preservation ... i.e. they will
be out of jail one day and we want them to be productive members of
society.)
4. Retribution comforts survivors and society and religious origins of
cleansing soul.
i. Rehabilitation and retribution can work against each other in
society’s perception
5. Incapacitation – isolate dangerous people from society.

State policies, whether imposing additional coverage obligations on insurers, not only produce economic externalities, including mobility by insurance companies and high-risk persons seeking coverage, but also political externalities, encouraging states that have not weighed in to select their regime in response to those of other states. The ACA is frequently understood as
solving a separating-equilibrium game at the micro-level: In the absence of the individual mandate, low-risk individuals often self-insure, whereas high-risk individuals fail to obtain health insurance or pay enormously high premiums. A
system largely dependent on employer-provided, family-based coverage infuses sufficient stickiness to avoid a total separating equilibrium, and yet the United States regime has undermined pooling by discouraging a large number of young and healthy persons from obtaining coverage at all and by preventing too many high-risk persons from affording coverage.

Economics professor and Rockefeller Center Director Andrew Samwick introduced Katyal as one of the “most qualified” people to speak about the issue. Katyal was appointed principle deputy solicitor general and then succeeded Justice Elena Kagan to become the first Asian-American acting solicitor general in 2010. Katyal was the lead counsel for the Supreme Court case Hamdan v. Rumsfeld, which dealt with the imprisonment of terror suspects at Guantanamo Bay. He specializes in national security, constitutional, criminal and intellectual property law and was named one of the top 50 litigators in the nation by The American Lawyer magazine.
At the College, Katyal majored in government modified with history, and he coached the Dartmouth debate team for a year after graduating before attending Yale Law School, Katyal said in an interview with The Dartmouth.
In addition to working as a partner at a private firm, he is also national security law professor at the Georgetown University Law Center.
“Teaching is the thing I love the most,” Katyal said. “I was not a great student when I came here, but I had a set of teachers at Dartmouth who took me under their wing and really taught me.”
