Date: June 30th, 2009 9:06 AM Author: trip jet indian lodge definitely honest. while he might not be the best writer (roberts and ginsburg are both incredible), i think he's one of the clearest writers, and that combination elevates him. he's less prone to resort to meaningless rhetorical flourish--you can't imagine shouting any of his lines like you could see in a scalia opinion. he and breyer, even when upset, write calmly.
also, he's the only one who is willing to stray from the "mainstream" of jurisprudence and think independently. a few justices do this once in a while--scalia on a couple of issues including executive power, or souter on religious liberties--but he is willing to do so consistently, and even in seemingly unimportant cases, like statutory interpretation. |

breyer and ginsburg are dead last in all of these respects. souter wouldve been there with him had he not left yesterday.
havent seen enough of alito though he doesnt seem all that special. but maybe he's biding his time before he begins pwning.
i think stevens and roberts are about on par with stevens probably ahead by a nose (lol get it?).... in due time roberts may catch up.
the clear-minded and thoughtful thomas is far ahead of the simpering fag AMK.

Not a fan of Alito's writing. Read his concurrence in the Ricci case -- I think my high school social studies papers were written better.
And I don't think Kennedy realizes that a major part of his job is to create standards that lower courts have to follow. His writing isn't bad or anything, and I often agree with his conclusions. But he's managed to muddy up otherwise straightforward doctrine (e.g., EP and SDP with Romer and Lawrence). And when he tries to create clear-cut standards, they often end up confusing lower courts (see the sexual harassment affirmative defense in Burlington v. Ellerth that can't be raised unless the employee is negligent). There's also a couple of crim pro cases where he could have made it 5-4, but instead forced a plurality by writing a stupid concurrence that only slightly differed from the plurality opinion. Ah Kennedy... when will you learn. |
