I agree. It is a shame, since it does shed light on a growing problem: Standard aptitude examinations (even with outside review and modification to avoid bias) leading to great outcry by various "reverends" if the results simply do not satisfy them.

Not so sure about that. My employment discrim prof actually spent a good amount of time discussing how this case could potentially answer a lot of questions. It probably hasn't, but the strong-basis-in-evidence standard will certainly put this hold in the casebook for at least a page or 2.

It may even land in ConLaw casebooks discussing Reverse Discrimination issues outside of EQP.
