Cleaning staff found “Damn Orthodox Jews” scrawled in a first-floor men’s room at 40 Washington Square South at 1:45 p.m. Monday.
Cops are poring over surveillance videos."
So...if I scrawled "I love Jews," since there is no hate, it's just a normal misdemeanor. But because I express hatred while also defacing property, it suddenly gets more government attetion? |

If you're intent is to intimidate a group of people, I think that's a legitimate mens rea element to incorporate into a more serious crime. If the act is just motivated by your dislike for Belgians, I think that gets a little closer to criminalizing opinions. |
