On one hand, this is insane and every other country on earth would never have such a corrupt and deranged tort system.
On the other hand, FUCK COFFE PLACES for serving coffee so hot. I'll gladly take on the full risk of burning myself. I'm not a faggot. But I hate having to wait fucking 15 minutes before I can drink my coffee because it's too hot. (I'm not one of those fags who puts gay milk or shit into my coffee -- drink it blacker than a Congolese Pygmy left to wander in the Sahara for 40 days).

starbucks is satan. i had to file motions to compel and got them sanctioned $7200 before they even produced the video.
this was back in 2020. they outright refused to participate in discovery until ordered by the court, their method of litigation was to get sanctioned instead of producing this damning video.

The likely theory of liability is product liability, specifically under the doctrines of defective design or failure to warn, as recognized under California law. Product liability in California allows a plaintiff to hold a manufacturer or seller accountable for injuries caused by a defective product, which can include defects in design, manufacturing, or inadequate warnings about foreseeable risks. Here, the claim likely hinges on the argument that Starbucks served coffee at an unreasonably high temperature -- potentially exceeding what is safe for immediate consumption -- and failed to adequately secure the product (e.g., with a properly fitted lid) or warn the consumer of the risk of severe burns.
California follows a strict liability standard for product defects, meaning the plaintiff would not need to prove negligence, only that the product was defective and that defect caused the injury. The temperature of the coffee, often cited in similar cases as being between 180–190°F at Starbucks, could be argued as unreasonably dangerous, especially if it exceeds industry norms or consumer expectations for a drink handed over in a drive-thru setting.
They presumably assert that the company’s operational practices created a foreseeable hazard. For instance, if the coffee was handed over in a cup with a faulty or improperly secured lid, the spill could be attributed to a design or manufacturing defect in the packaging rather than solely the plaintiff’s handling. California courts have recognized that businesses can be liable when their products, as delivered, pose an undue risk of harm, particularly if the consumer has little control over the initial presentation (e.g., a barista handing over a scalding-hot drink).
Additionally, the failure-to-warn theory could come into play if Starbucks did not sufficiently alert the man to the coffee’s extreme heat or the potential for the lid to dislodge, especially given prior complaints about lid issues documented in other cases. Under California’s consumer protection framework, businesses like Starbucks have a duty to ensure their products are safe for intended use, and serving coffee at temperatures capable of causing second- or third-degree burns in seconds could breach that duty if not mitigated by proper safeguards or disclosures.
California’s application of proximate cause and comparative fault will shape the outcome. The plaintiff must show that Starbucks’ actions, or inactions, directly led to the injury, but the state’s comparative negligence rules mean his own handling of the coffee could reduce any damages if he’s found partially at fault. Starbucks might counter that the risk of spilling hot coffee is obvious and that the man’s actions (e.g., placing the cup near his lap) broke the chain of causation. However, if evidence suggests Starbucks knew of recurring lid failures or served coffee hotter than necessary without adequate precaution, the company could face liability.

Dang. Was it one of those little 4 cup cardboard holders that are maybe an inch high? I'm a little surprised they use those for hot drinks given the spill risk.
How did it get his groin? Was he in his car?
Is there more at play here regarding how he got so badly damaged? I feel like pouring 12 oz of 190 degree coffee onto a lap covered in pants and underwear would be bad, but not eviscerated penis, $50M damages bad.
