I thought the opinion actually did a decent job of defining "rebellion" and noting that it isn't anything like the current protests and rioting. The court really stretched on the third prong, though I'd like to see some legislative history on what the drafters intended by "unable". The extreme deference that the courts and congress have given the executive is part of why we've been devolving into an "imperial presidency" for the past century. Maybe Trump's norm-breaking is finally the impetus to restore some balance.

He's writing with regards to whether angry and violent protests constitute a rebellion. I think he's right in the sense that there's some sporadic and violent acts against some cops and not an organized, open rebellion against the US government. Punching a cop is not a rebellion. I think it's a disingenuous stretch to say that the protests were a rebellion as that word is used in the statute.

We already have a law that provides some requirements before the president may "federalize" the state's national guard. You're arguing for an interpretation of that statute that gives extreme deference to the executive. I'm pointing out that decades of that extreme deference from the courts may have landed us in the current situation where a wannabe strongman can act unimpeded. My argument is not crazy. first, the judge granted sweeping injunctive relief that the State of California never even asked for. that's a weakness for California on appeal.

second, there are factual premises that some people are claiming were not in California's brief and that are not true anyway.

third, by claiming to grant a TRO, which normally isn't appealable and which California didn't ask for, the USDC judge has muddied the waters.
