We talked to five of the eight jurors afterwards, and they told us that they decided the case because “the contract says [completely irrelevant point that neither side had argued because it has no bearing on what was actually in dispute].”
This happened in another trial we lost. I take from it that jurors like to be iconoclasts who imagine they alone discovered some secret key to the case that all the lawyers and the judge had overlooked in the two years of pretrial proceedings. I’m going to try to think of ways to counteract that tendency. |

We got a verdict in our case yesterday... 1 million, will be 1.3-1.4 after 998 costs/interest etc.
Definitely less than we were hoping for but still a win when defense's best pre trial offer was 77k. They offered the 250k policy on courthouse steps. We said no. |

Defense counsel who tried the case all had to parachute in last min and even they agreed State Farm had bungled the case. They did ask the jury to award nothing and if they were gonna award somethign that it should have been well under 25k.
It was interesting, we had 4 women as pegged as all in for our guy. Turns out they wanted to fuck us and dragged the number down. All the men in the backrow wanted to give us 2-4 times the number. |
