To my knowledge, at most schools profs have the discretion to modestly raise or lower grades based on participation. I'm not sure if this is done pre- or post-curve.

I don't really have any stories, but I suspect my grade was lowered on more than one occasion because I stopped going to class after Sept. of 2L year.

It's a great incentive to 1) attend class and 2) participate.

I've taught at the undergraduate level before, and I can tell you that I hated to call people out for poor attendance, and also, teaching class where nobody participates is a demoralizing experience (and it makes things pedagogically difficult). So I think as a matter of just encouraging people to be good students, it's a pretty sound policy.

In my experience, these people were generally deadbeats and never did well in my classes. By and large, the gunners ended up being the best students, and my favorites, since they put in effort, even if it was not motivated by a genuine desire to learn the material. They at least pretended to grapple with what I was teaching them, and that went a long way with me.

I mean, I skipped 2/3 of my classes in law school, so I'm not judging.

At NYU, prof's are permitted to raise/lower grades in lecture classes by at most a half-letter. Around 20% completely disregard participation; 40% employ the system in such a way as to only negatively affect unprepared students; and 40% use it to both punish unpreparedness and reward those who make special contributions to class discussions on a regular basis.

I'm usually prepared but seldom contribute to discussions. I sense that this has reduced my GPA modestly--not enough to entice me to really participate.

At Chicago there were definitely some that lowered my grade about 2-4 points (basically from B+ or B down to B-) for not showing up to about 1/2 the classes. Total BS, because it wasn't in the syllabus, but it wasn't like I could defend not going to class in an appeal of some sort. Didn't find this out 'til I looked at some of my old tests in the archives 3rd year. The nonparticipation deduction was written right on the tests. Sometimes it was inverse, like everyone who went to class got +2 t o+4 points, but it was the same net effect.

So it probably doesn't have to be in the syllabus for it to be legit.
