Date: September 10th, 2010 5:25 PM Author: Sooty Contagious Circlehead the false claim would have to be school specific anyway so its very possible to imagine a scenario where a schools specific fraudulent claim is not public knowledge. Realistically you'd need a whistle blower coming out of the administration, financial aid or admissions office. The 2009 amendments to the act change the definition of what is a claim and what is a false statement making things much easier for plaintiffs.
Also, there are state FCA's that often are way better to sue under than the Federal act. The NY FCA in particular is kinda awesome. |
