1. They're actually pretty common, but I find emotional neglect and emotional battery complaints baffling. I can still do a pretty good job on these, but typically I get a colleague to look over my stuff first because it's hard for me to sympathize. If you're just asking about outright weirdness, we might have had a client who was getting gaslighted by her spouse. He would hide shit around the house and tell her she was going crazy. She caught him doing it on camera.

2. I mentioned one already: adulterous woman accused her husband of child abuse, left him for a pedophile. Another case involved the judge having an affair with one of the parties (did not come out until after the divorce settlement).

3. Sometimes, though usually they don't retain lawyers.

I would not get married. Most of the benefits can be found in a long-term relationship and marriage affords very few legal protections, especially for men (it's no picnic for women either). You're very much at the whim of the system. A lot of clients don't seem to understand how no-fault or pre-nups work.

That said, I'd be sure to initiate. Frankly, by the time either side is even threatening divorce, the marriage has deteriorated beyond repair. In my experience, judges don't really seem to reward good-faith efforts by one spouse to "fix" the marriage. It's best to make a clean break, but keep it amicable.

If the couple had children, sure. You'd probably want some formal agreement for visitation and child support.

The mediator usually offers general legal advice and tries to give both sides an understanding of what their options are. The goal is to work to an equitable outcome and avoid conflicts. You can still retain independent counsel (in fact, it's recommended).

There was one case when I was just starting out, but I wouldn't really count it as amicable. We had a conference where our client was going along with everything her ex said, including things she had clearly established earlier were "non-negotiable." I cut the meeting short, did a little digging, and found a domestic violence record (she had not mentioned it, but it was still carelessness on my part). Filed a restraining order and negotiated directly with his attorney from then on.

Meaning, there are rules & laws & accountability, and someone's finally looking at one's behavior & actions. If it wasn't for my lawyer, the mediators, the judge, even his lawyer, there'd be no stopping his craziness. There's no accountability in marriage, and even less in a living-together non-marriage. I felt vulnerable in my first marriage, but I felt protected and chaperoned in my divorce.

I once worked with a woman whose ex owed her child support but he also had like four other kids. Because he owes her and her kid is the first of his five, she gets first dibs on his tax returns and wages are garnished until the full amount is paid out.

I've never asked, but once her kid is 18, does that likely end or will she continue to get paid until the amount he owes is zero?

What do you mean by "consideration" of the prenup? Child support and custody can't be settled by prenup, so there will be substantial modifications made, even if the judge uses it as a starting point.

It depends on the judge. Some will take a substantially fair pre-nup in an otherwise amicable divorce as a starting point for deciding what's fair. The terms will always be adjusted if there are kids.

1. We generally get ours through referrals from other lawyers. For example, a lawyer who did estate planning for the couple cannot represent either party in a divorce. We may also get referrals from mediators. Other firms rely on higher volume, so they advertise in the yellow pages. You have a few who have the "battle axe" reputation; most of their business comes via word-of-mouth.

2. I don't know, since I've never practiced solo.

3. The law is pretty basic, but family courts run on equity.

I could not do your job at all.

Family law has to be the most miserable field out there.

Even with Criminal Law you just show up for a few court appearances and the have the Def. plead to a good deal from the Prosecutor.

But Family Law?
