Wh not just turn over all material over to the defense?

I don't know any unethical ones. I know lots of lazy ones, and that's where discovery problems happen.

We generally turn everything over. The only exceptions I can think of are things such as victim's address, phone numbers, etc and things like informants who have an ongoing relationship with the police. There is very specific case law on that stuff, though.

It shouldn't be, but there are always legal line-drawing questions. For example if we know about surveillance but it is not in our possession, do we have an obligation to get it from who has it and turn it over or is it the defendant's job to find it on his own?

I like the work I do, but is gets harder evey day to stay. I make the same as the day I started in 2007 and my patience for that has a short shelf-life.

I wanted to be an AUSA when I first got out of law school, and am starting to apply for those jobs. Otherwise, may insurance defense, something like that. I'm not ready to completely sell out and go criminal defense yet.

Movie was a fun story, but not remotely realistic. I'm just a point where I am ready to help make the streets more dangerous, fake indignation about police not doing DNA testig when there is a confession, etc. But my desire to stay in my current job is gong downhill fast.

The part where he gets the prosecutor and judge to continue the hearing because his client hasn't paid him was pretty realistic, tho.

In my cases, it is almost guarenteed that the attorney is going to ask for a continuance, simply so the client can cough up the necessary dough.

PD are all types. Some of them are the truest of believers and don't have to hustle to get clients, make money etc, so they are idealogues, which gets annoying. Other are just there for the government check, won't force stuff to trial, etc. Privates are usually more annoying becuase you don't know the that well, and they file all sorts of frivilous shit to justify their fees.

Brother, I stand behind you. I know the frustration of not making enough money and having a constant deluge of work. I offer you this thought: those who go to insurance defense shops are infinitely more unhappy than you are. I hope you get an AUSA position. That will appeal to what you find interesting, the pace will likely be slower, and the pay much better.

My favorite story would out me because of the national news thing. But a second favorite is this arrogant guy who didn't think his abuse victim would show. She did and lied for him. I impeached her with her recording. he got convicted. When they read the verdict, he threw a water bottle at the jury and yelled, "Fuck you how are you going to convict me? I got kids motherfuckers." He ran out of the courtroom and got his face planted into the sidewalk by court security.

Btw I would seriously recommend going to a firm where a partner will be on your ass to squeeze every past billable out of you. It would be a rude awakening I imagine coming from a nice govt gig

I work 50-60, twice that if in trial. Some supers are assholes; some handsoff. It just depends on the personality. But there is a chance to get on a power trip for the wrong type of asshole.

How important is criminal law, demonstrated interest. etc.?

I.e. can someone who's magna at T14, 1 year Biglaw, generic law civil background compete with some hotshot from the local TTT who's obviously been gunning for DA/crim law his whole life?

And I guess, is this at all the same rigid career path as private firms, where you're either entry level or 3-4 years experienced, and you're outta luck in between?
