I am currently in BIGLAW and was thinking about joining the military as a reserve officer. From what I understand, I would have to go through a few months of training as a reserve officer after I join. Can I get fired from BIGLAW if I were to tell my partner that I plan on doing this? Or if I already sign up and the military requires me to go through that training and I would need to take a leave of absence during that period?

I figured that would be the case. I want to join the military as a reserve for the right reasons, e.g., for my country. But, I also think it is a good idea to take some time off from the law while I go through the training.

They are not required by law to keep a job for you. They can downsize you out if they choose to do so. It happened to a buddy of mine who was in Midlaw.

Freaking board swallowed my epic poast on this topic.

Short version:

I've done this for a while (NY, V30).

You will piss off many of your co-workers, who will have to pick up your slack while you are away doing things they don't really understand ("Drill? Is that like marching band practice?").

You will probably have a hard time doing well in your military career and keeping up with the firm's demands. Especially as an officer, you have to deal with all kinds of random business during the month between drills. People get injured, people get sick, people want to transfer, people want to go on extra AT, people are mobilizing, etc. Staying on top of that stuff takes a substantial amount of time.

Depending on what you want to do, reserve service can be worth it. I think it also helps keep you grounded. But it's not something to do as a hobby.

As long as my firm can't boot me while I do this I am fine. I know I can still bill 2000 hours. It is October and I am only 200 hours away from reaching 2000 as is. I think I can pull it off with reserve.

True. Lets say my hours drop at BIGLAW because of my time commitment to reserve, they still can't fire me right? Also, I really don't care about making partner because I plan on leaving as soon as I find something in the federal gov sector. I figure military reserve will help me get a fed job.

It would be a lot easier to justify your reserve duty if you came into the firm as an existing reservist. But the fact that you are affirmatively seeking out this service at this point, after already having been at the firm for a few years, would raise some eyebrows from your partners. I'm not saying it's not a noble pursuit, but some people may view it as a way for you to have a built-in excuse to avoid work for a few weeks a year.

That being said, there's no way they would fire you explicitly for this reason. There may also be some partners (ex-military guys especially) who think what you are doing is worthwhile. But I think on a net basis it would be a negative for your BIGLAW career, at least at your present firm.

If I were you I'd try to leverage BIGLAW + reserve into a sweet fedgov gig, where reserve duty is a point of pride.

i am currently doing this. it's NBD. i'm on track to bill about 2200 this year. kept billing through my two week annual training, though only about 10-15 hours a week. probably easier to do this because i'm in litigation. i think litigators typically don't work on weekends, whereas corporate guys work whenever the client wants them to.

nope, not at all. it is along the same lines of how people are afraid of seeming racist if they discriminate. people are very considerate of reserve military service obligations. the guy above has a point though: i was in the reserves going into biglaw. if you joined after alraedy being in biglaw, i could see that being a problem.

nope. not unless you are really gung ho. but i am very disillusioned with the military, so maybe don't take my word for it. joined because i was a very patriotic teenager. i would never do active duty... that would be hell. i've had some great times and experiences in the military and the guard, but for the most part it is just an epic pain in the ass.

There are branches (Navy, Coast Guard) that have direct-to-reserve officer accession programs that are basically a drill schedule. Apart from it being nearly impossible to get a commission this way with no prior service, I think it's more disruptive to be away for a bunch of shorter periods of time than it would be to just be gone for 9 months or a year. That said, there's a noticeable difference in people's attitudes when you're going away for training vs. mobilizing somewhere unpleasant overseas.
