I support striking down the d/p on Eighth Amendment grounds generally but for the reasons I've suggested, I'm less certain this court's arguments are the right arguments to bolster that constitutional claim. Regardless, I hope the dispute has the effect of spurring proper funding for capital appeals and post-conviction review so the delays are less likely to materialize. [Of course, I agree with Doug Berman's general view that the d/p is a sideshow to the more mundane and pernicious and pervasive problems with noncapital punishment.] That said, the claim that "justice" delayed is no justice at all, and indeed, unconstititional, needs more work -- so it seems to me. Yeah, yeah, she probably wasn't involved, and it was probably some mistaken identity drug/robbery thing, but a hit man would explain why a killer would randomly show up in at 11 am in a nice neighborhood blasting away the moment the dood opened his front door (as twitter rumors are saying the incident went down). There aren't many murders where you can say the facts are ripe for it to have been a contract killing. This one seems, at an inital glance, to have those facts.

It's not like this was an NYT feature seeking to expose her. It was a website promotional "interview" meant exclusively to cast her in a positive light.
The seeming fact that she was comfortable with her image being broadcast in that way leads me to think the interview was more of an insight into her persona than an isolated mistake from a person going through a tough life moment. If my inference (admittedly based on limited evidence) is correct, what does that say about her? Not a lot of good stuff. More relevantly, her detachment and bitterness and lack of good sense are all things a homicide detective would be looking at in wondering about motive if the case cannot quickly be written off as a botched home invasion or case of mistaken identity (or suicide). |

Conventional wisdom is that it’s not the place of a clerk to Judge X to reprimand the clerks to Judge Y for weak work product; that’s Judge Y’s prerogative. But Dan saw things a little differently. After the clerks from another chambers produced bench memos that turned out to be below average, Dan walked up to the clerks from the offending chambers at oral argument and expressed disappointment in them for what he viewed as inadequate bench memos.
Impolitic? Yes. A breach of protocol? Certainly (and Judge Hawkins reprimanded Dan for it after finding out). But the incident also captures the kind of person Dan was: the total opposite of a “that’s not my problem” or “who cares” kind of guy. If someone else had a problem — a student struggling with a difficult concept, a fellow law professor having a hard time placing an article, a blogger going down a misguided analytical path — it became Dan’s problem. He cared — so deeply, maybe even to a fault — about people, and ideas, and the entire world around him. It makes perfect sense that his scholarship focused on justice; Dan simply couldn’t abide injustice.

Make no mistake: Tallahassee Police Chief Michael DeLeo – on the job just more than six months – has already demonstrated the kind of straight and honest approach that has been missing at the top of the department for too long.
But straight talk at the top is not enough to rebuild public trust. The department must also understand it has huge image and credibility issues to overcome. That will require more than just coming to the community for conversations about violent crime and forming community advisory groups.
Beginning with what could be called - at best - misleading information from police in the Rachel Hoffman case in 2008, the police department has been its own worst enemy in trying to build public trust. It has totally misunderstood the importance of communicating with the public, much less even tried to do it well.
Just last week, the Tallahassee Democrat reported on a shakeup in the police department's forensics unit after years of what has been called dysfunctional operations. DeLeo did the right thing in dealing with issues in the department, but nothing was said to the community until the newspaper discovered it.
Last fall, the newspaper reported on its investigation into poor communications, inconsistent and at times misleading release of public information and the failure of the department to provide basic information on crimes. That series of stories, which included our reporting on the Christina West case, won first place for investigative reporting from the Florida Society of News Editors this month.
Even now, the death of popular Florida State law professor Dan Markel in his home in Betton Hills has neighbors complaining about a lack of basic information from police. They need to know whether there is a continuing danger in the neighborhood. Markel was found Friday with gunshot wounds after police responded to reports of a "shooting incident."
"We don't want to compromise the investigation," Lee Avirett, who has lived in the Betton Hills neighborhood for 35 years, told reporter Sean Rossman on Sunday. "Do we need to be more on our guard than normal? We just need a little information."
It wasn't until hours after Markel's death, as social media and the neighborhood were rampant with rumors, that police even acknowledged the shooting.
Attorney Reggie Garcia, who also lives in the neighborhood, likened the information flow to "radio silence."
DeLeo has already shaken up more than the troubled forensics unit. He has put into place a new leadership team, presumably one he is more confident will reflect his values, professionalism and commitment to public service. He is determined to address critical issues in the community, such as gun violence and other violent crime, saying rightly that it is a community issue that will require a community response.
He has called on the community to get involved in addressing violent crime and expressed surprise that the community wasn't more aware of the level of crime in the area. He shouldn't be; for far too long, police have done everything they can to prevent the public from having the information it needs to address such issues.
To properly address violent crime in the community will also require a reinvestment in the police department by city leaders. I have no doubt that we will need to add police officers and reorganize to get more feet on the street if we are going to make progress.
But before that can happen, before the public – and I suspect city leadership – will want to invest more into the department, DeLeo will have to deal with the sad public perception of incompetence and lack of trustworthiness. I say sad because that is not the true reflection of most in the department.
Before the department can move forward, before the public is asked to invest more money into the department for additional personnel and training, the public must have confidence in the department. The Tallahassee Police Department must deal with its public relations issues. They are deep and, as we saw this weekend, not going away.
TPD is still living with the consequences of facing national ridicule in cases like Hoffman and the too-little, too-late investigation into a sexual battery allegation against star football player Jameis Winston.
If police want to win back the public's trust, they has to show trust in the public. If the department wants the public's respect, it must respect the public's need for timely information. Trust and respect are streets that travel in both directions.
And no amount of public expenditure can change that. |

Thanks for bringing attention to Professor Dan Markel's censorship over at Prawfsblawg.
Yesterday, Markel deleted my post where I made several points: 1) the inane tone of Michael Teter's guest post; 2) Teter's tepid unwillingness to comment one-way-or-the-other on Professor Campos' efforts as emblematic of a risk averse professoriate; and 3)Dan Markel's unreasonable, inconsistent and hypocritical comment deletion policies.
To me, Dan Markel is a junior varsity version of Brian Leiter. Dan talks a tough game like Leiter but I think he has a very fragile self-image. He desperately attempts to silence dissent and purge those whose comments disagree with his elitist and privileged worldview (Harvard/Cambridge/Harvard Law/9th Circuit Clerk). Prawfsblawg is purportedly dedicated to "intellectual honesty", but Markel doesn't support intellectual honesty. He is the epitome of the legal 1%ers endemic to legal academia. He tries to play the imperious professor role with non-academics by attempting to silence them. Little does he realize how pathetic, shallow and mean-spirited this behavior makes him look. Earth to Dan: you mean nothing to legal practitioners or those of us in the "real world" - you are a paper tiger!
Markel recently deleted comments questioning the ethics of professors accepting free food and drinks purchased by the Fourth Tier Drexel School of Law. He then closed the thread for additional comments.
Yesterday, he deleted my comments on Professor Teter's thread.
While we need to keep the heat on Leiter, I think academic thugs like Markel deserve a little attention as well. This guy has been flying under the radar for far too long. Bullies like this need to be made radioactive. their arrogance and imperiousness speaks for itself. All means necessary must be employed.
Clowns like Markel don't realize that the firmament they stand on in legal academia erodes every day. The public isn't on their side. They have the losing hand. |
