Most of his clients are distressed middle managers trying to get a leg up on internal rivals. If a half-brained college kid can blackball someone for $500, there's something seriously wrong. |

Lawsuits are already happening over this sort of thing, and I wouldn't be surprised if there've been a few more violent crimes, but they'd tend to be contract killings (being initiated by sane people who care about standing/reputation) and therefore under the radar. Consider how easy it is to Google-rape someone and skirt around blacklisting laws. Law is catching up with the technology. |

These hit jobs aren't going to become so common that employers excuse Google dirt. Most employers are going to assume (probably rightly) that a private individual is an unlikely target of a Google attack and, being Bayesian, are going to assume the person is just unsavory. At the very least, there is a higher risk of the person being unstable.
Analogy: if you have a really terrible boss who gives bad references (even though it's illegal, it happens) it is quite possible that you just had a shitty/vindictive boss. Shitty bosses are a lot more common than digital hit jobs. However, future employers won't know who was at fault, and the bitterness between both parties makes both look bad and saying "I had a bad boss" at the interview won't buy you out of it. (In fact, it makes matters worse.) Your chances of getting the job are severely reduced. Which is why blacklisting laws exist in the first place. |

They do these things for their purposes, no one else's. You would have to make it difficult for them to do these kinds of searches on a very large scale. For example, if you could make the top 20 hits for the names of 100,000 young professionals link to tubgirl, you might make a dent.
Surely, they know Google dirt is unreliable, but they use it anyway. Why? For the same reason some police forces use the unreliable and unfair information of race in assessing criminal likelihood. Unless there is an enforceable law (which is unlikely in this case) prohibiting the use of certain information in a decision-making process, it will be used unless its reliability is perceived to be not merely very low, but zero. Google dirt's reliability is known to be more than zero. |

The material problem is that many people do use their full names in linking or refering to the contest. To a hiring partner, doing a casual 2 minute google, it may very well look like these women agreed to participate and submit photos. That could cost them a job offer. |
