There might be a little bit of extra wiggle room I'm not thinking of, but whatever it is would require substantial extra elaboration that begins to sound ridiculous. For instance, police could theoretically have shaped Jay’s account around call records they already possessed, but the conspiracy required for that to happen really strains explanation. I think she understood this to an extent, and even directly asked him about it at one moment saying that that was the one thing she couldn't get past (the cell phone tracking and the phone calls), and Adnan essentially laughed and shrugged and said I don't know how to explain it. But she left it open as if that was a legitimate response (from what I remember it's been like 10 years since I listened to it).

You know what was especially embarrassing with Making of a Murderer was the "sink example". Of course someone can collect fresh blood and place it inside a vehicle under controlled conditions. That's not even the relevant question to be asking. Avery having been inside the RAV4 while bleeding directly predicts the evidence. The sink theory was constructed afterward to accommodate the evidence and requires a chain of unsupported actions. So his legal team went into the bathroom and poured blood down the sink, then pulled the sink out and extracted blood from it and ran over to the car in the junkyard to see if they could successfully plant it. I think iirc they were trying to prove that that one step dad guy could have done that to plant Avery's blood because he knew he had cut himself that night, and was handy enough to take the sink apart.

No this is wrong. I agree the case against the retarded cousin was weak, although he was likely there for some of the events. But the case of Avery was even stronger and more clear-cut than that against Adnan. Specifically because Avery was connected to the photographer's disappearance by several pieces of physical evidence, not just motive, testimony and timeline. They found the girl's rav4 ON the property, with Avery's blood inside it with her devices burned in his barrel. The key to her vehicle was found in his bedroom with his DNA on it, and a bullet with the girl's DNA was found in the garage, and linked to a rifle found in his trailer. You have multiple independent evidence streams converging too, so even with a bad faith investigation there is enough there to say he did it.

--The car key was found after multiple searches of the same room. Seems reasonable to assume it was planted

-- He didn't have a motive other than the other allegation that he raped her

-- It took weeks for the detectives to decide the "burn pit' contained human fragments

-- The bullet also took MONTHS to discover and came up after they ahd searched it multiple times

So a reasonable person has to conclude that either (i) the cops are just really inept at missing all this evidence during their first multiple searches or (ii) they planted the evidence. Given their conduct with the retarded kid, I lean heavily towards (ii).

Not to say that Avery didn't do it, but I do think that 90% of the "evidence" you posted was planted by the police (and without question it was stuff they inexplicably missed their first searches).

The one alternative I think is viable is that Bobby Dassey killed her, and then Avery later helped with the disposal. There are still issues with that, not going to go into all of them. One thing I find really suspicious is that Bobby Dassey's "alibi" is that he went hunting right when the window where she was killed happened, and Scott Tadych corroborates it. Avery might not have felt the need to construct an alabi, because he thought he was in the clear because he just helped with the disposal and didn't actually kill her. There are still issues with this account, but it actually explains the family and behavioral dynamics and evidence really well and is much better than the Bobby Dassey only and Bobby Dassey framed Avery account that his lawyer tries to later use.

Apparently there is an alternative documentary called "convicting a murderer" that shows tons of stuff was left out, and even redditors were saying it is 100% certain Avery did it.

Didn't Avery also call her out to his property for some reason? Like he requested her to come out or something to that effect and then she disappeared shortly thereafter.

Obviously people see that he was wrongly convicted in the past, but I always got the sense that the police actually knew MORE about this guy that they maybe couldn't outright prove and wanted him off the streets ASAP.

The funny thing is that there is effectively no way Avery would get any sympathy today off the simple fact that he's a white male. And I think way more people are onto the fact that The Innocence Project is fucking insane and regularly gets real criminals out on absurd technicalities.

Fucking lol. People can prattle on about "well what if the police planted some blood" but it's like, uhhh, who else killed her and why were her things burned in the barrel on his property? Why was there blood all over the garage floor ("but but forensics can't actually prove that! I saw CSI!")

All these theories for Avery and for Adnan rely on some One Armed Man being out there and just randomly killing a person at a time so inconvenient to those arrested for the crime that it beggars belief.

Hundreds of years ago a guy like Avery would've just been killed by someone with sense and that'd be that.

Established by conviction or Avery’s own admission:

In 1982, Avery was convicted of animal cruelty. The trial court later summarized the incident as Avery building a bonfire, soaking a cat in gasoline and oil, throwing it into the fire, and pouring more gasoline on it after it escaped. This is not documentary embellishment; it is documented criminal conduct.

In 1985, he was convicted after pursuing his cousin Sandra Morris, striking her vehicle and forcing it off the road, pointing a loaded rifle at her and ordering her into his vehicle. The court noted that Avery admitted much of Morris’s account to detectives.

The 1985 rape and attempted-murder conviction involving Penny Beerntsen must not be counted against him. DNA evidence exonerated him and identified another perpetrator.

Serious and partly documented, but never adjudicated as crimes:

His former wife Lori was prepared to testify that he choked, punched and hit her and threatened to kill her if she left. Court records reportedly included letters or cards containing threats against her, and a family-court finding referred to threats to kill and mutilate her. These are more substantial than anonymous rumours, but Avery was not convicted of those alleged assaults.

Jodi Stachowski reported that Avery slapped and punched her, threw her down and once choked her until she lost consciousness. The prosecution also cited a recorded call in which Avery allegedly instructed her to deny the abuse and attribute bruises to falling while drunk. Again, no conviction resulted from these incidents.

Sexual allegations—not established convictions:

A 17-year-old relative alleged that Avery forcibly had intercourse with her while restraining her hands and threatened to kill her family if she disclosed it. The State said Avery had made statements acknowledging sexual relations, but not force. He was not tried or convicted on this accusation.

Another woman alleged that Avery sexually assaulted her in 1982 or 1983 while she was staying with Avery and his wife. This also remained an allegation rather than an adjudicated offense.

Sandra Morris alleged that before the armed-road incident, Avery repeatedly exposed himself and masturbated as she drove past. The court recorded the allegation, but it was not the conduct for which he was convicted.

Some additional material sounds sinister when edited into a documentary but is much weaker. Avery reportedly greeted Halbach wearing only a towel on an earlier visit. He also made a crude sexual invitation to another woman the day before Halbach disappeared, but the court specifically observed that it was a request for consensual sex, she refused, and he did not pursue it. The court found that evidence essentially irrelevant to whether he later committed rape or murder.

I was forced to listen to that episode while driving back from a cabin with a friend group and by the end of the drive back I knew that I was never hanging out with any of those people ever again. 99.9% of people are so easy to brainwash it's just comical, especially women. Yeah I recall multiple people acting like I was ignorant for thinking he was guilty. Someone said to me "if you believe Jay I can't help you". It's amazing most of these people seemed to think that if you could poke a few holes in the prosecution's timeline or in Jay's story it means the entire thing needs to be thrown out and there is "reasonable doubt". It's like they are unable to reconstruct the actual underlying constraints and structure from unreliable narrators.

It's so frustrating that these people who are convinced after one transparently biased podcast accuse people who do supplemental research of being closed-minded or ignorant.

It's very understandable that someone who just listened to the podcast would think Adnan = innocent and there are some questionable aspects of the case, so I (and I'm sure you) were never like "if you think Adnan is innocent, you're an ignorant retard!" But this was a common reaction from the other side when I said I thought he was guilty.
