have seen this a couple times now:
moving companies are offering 'free storage for 30 days' to their customers if their new house isnt ready or whatever. customers don't know that moving companies are just puttng them in storage at a national chain that is offering free storage and often dont know where their items are stored. the customers think their items are being stored at the moving companies' storage facilities but the moving companies dont have any. moving companies fail to pay the monthly rent after 30 days, all items are auctioned off. have seen this a couple times now.
moving companies open and close and aren't good for the judgment but the national storage facilities definitely are if i can figure out how to bring them in.
my thought is, national storage facility must know that moving companies are storing customers items there, take no action to discover the true owner before auctioning, and don't provide notice to the true owners before auctioning. my guess is the national storage facility will say that the movies co's were acting as agents of the customers and they only needed to provide notice to the agents.
second, its illegal to offer storage services where i am if ur not a licensed facility. all the moving companies do it though. the storage facilities know that its illegal if ur not licensed yet let the moving companies store their items their anyway. deceptive practices violation. etc.
third, storage facilities have a lien on your items when they are stored there and the bill isn't paid. possible to enforce a lien on third party's items though?
