Garcia's attorney knows that the reward will be reduced; that's why he went for a high number. I just have a small hope (probably useless) that Garcia is not going to have to hand over more than the usual 33 and a third percent of the reward to the law firm.

Actually 33 1/3%, the statutory maximum (in CT & most states) only applies to a certain amount the percentage drops based on the size of the settlement. The more the plaintiff wins, the lesser the cut of the attorney. Fees can, and usually are, a completely separate fee because they’re considered reimbursements. I have a feeling that Starbucks’s will get the judgment significantly lowered on appeal. $50 million is definitely excessive, but then again we aren’t the ones who were hurt so badly. Skin grafts are no fun, I hope the victim recovered.

As much as I dislike their products, Starbucks bears no responsibility for a clumsy customer or a jury with a wicked sense of humor. As for the ambulance chaser, he's part of the reason that there are only skid marks leading up to dead snakes on the highway. Overturned on appeal, Dollars to doughnuts.

wedged into tray "well enough" ---- highly subjective criteria. Appeal of course. I have no empathy for drive thru folks --- it's a higher risk way of getting your food, your choice.
