Your choice is:

(1) $2M tax free, right now

(2) Any time you write a filing-ready motion (including supporting memorandum) or opposition to a motion, you will immediately be able to forsee the judge's exact ruling on the motion that will issue. You can use that info as you wish, including to change your motion, which might, in turn, change the judge's ruling. No funny business like speculating on next week's lottery numbers and seeing if the judge put the real ones in his order for you to see.

i would take $20k cash right now over being able to know a judge’s ruling after it’s been issued.

two easily. the settlement value of a case changes dramatically after the results of a MTD and MSJ. the delta between these over just a handful of cases is easily worth $2m. that's on top of the value you get from knowing the results of all sorts of other motions. hell, even if i couldn't capitalize on it, just knowing i didn't have to think and prep for an adverse ruling half the time would be worth $2m in QOL.

How would you use it? Do you have cases on contingency? If not, it's more difficult to directly monetize it.

Yeah, at my firm in Missouri which specializes in construction litigation, we take matters on contingency frequently. We use a local former HS football star to advertise because we think we have a unique brand position with that arrangement in that particular practice space.

2. This would be an incredible hack, especially if you also got to know precisely when the Judge would rule, as that would give you a huge strategic advantage as to what you could do in the interim before the ruling issues (which is generally a lot of time because judges take years to rule on motions usually). It’d be a great skill to have and it would be very lucrative, but it would also be difficult to scale and to really maximize option 2 you have to devote your life to the law, which some may not want to do.

Good hypo.

Money and scholarship. I really don’t like appeals so I would t go that route, but I’d definitely use it and really beef up my motion practice. You could get pretty beastly on the billable hours if you knew that you craft a laser focused motion in all your cases, probably could handle a bunch of cases and a bunch of associates, and it’d be like conducting an orchestra.

Of course you’d have to find associates willing to work hard, which is next to impossible. Perhaps the next psychic superpower should be an uncanny ability to determine who will be a good hire in terms of productivity, how much you can pay them to keep them motivated and at maximum profitability, and when/why they will leave your organization so you can call audibles as needed or manage your staffing needs longitudinally rather than just hiring randoms because you’re in a tight spot.

I don't see how knowing your argument was shit would give you any significant leg up in improving it, you already did your best and now you just get a flashing light that says you're fucked? Delusional to think that would help, motions aren't coin flips

If you go the route of trying to improve it, you can change arguments, cite other cases, cite other evidence, and see if that works.

If you go the route of accepting the outcome, you can plan accordingly. E.g., change settlement value accordingly, focus prep for next phases of the case in other areas.

And just generally, you don't have to sweat what the outcome will be.
