We could have a decision on that one by Tuesday. I predict SCOTUS refuses to lift the stay and refuses to hear the appeal. Virtually every statute we have on this seems to assume that if the POTUS is commanding the National Guard within a state, the governor of that state has asked for help. No one in Congress ever imagined a scenario where the governor is saying "we don't need help" but the POTUS is deploying the NG in that state (http://www.autoadmit.com/thread.php?thread_id=5787602&forum_id=2Elisa#49358728) |
