We have a case where two executives of their client were recently imprisoned for Medicare fraud, so we mentioned that as an "other discovery issue" in our 26(f) report (b/c you need a court order to take depositions of prisoners). Their head of shitigation for a satellite office freaked out, telling me "This information would not even be admissible as evidence under the federal rules."

I was like bruh do you even shitigate?

yes, two cases. Granted with a satellite office. Beat them on both. The first one they lost on summary judgment and they made a motion to reargue (state case) where they went off on the judge basically saying that he copy and pasted large portions of the order from prior decisions without bothering to analogize the law to the facts at hand. It was pathetic and probably driven by an angry client. They lost the appeal too. Other case they actually did a good job for the tough position they were in and also lost on summary judgment.
