I skimmed it; I think you (and the con dissent) are basically right as a matter of policy, and even the majority seems to sheepishly agree somewhat; however, the plain language really does cut against the weed company (and, as Jackson notes in her concurrence, the statue explicitly tells courts to give it a broad interpretation).

Specifically, the pattern and predicate requirements are not that easy to meet. But I can definitely see plaintiffs' attorneys fashioning their claims to get them in federal court for the RICO treble damages and attorney's fees. But are you saying that PIs are going to start claiming "my plaintiff's slip and fall on the Flying J's wet floor is the result of Flying J management unlawfully engaging in a pattern of negligence around store cleanliness in violation of XYZ?" |
