i'm skeptical because i assume the federal courts will grant a journalist some latitude unless he was a ring leader or was particularly aggressive.

looks like the 8th ruled that DOJ has another avenue -- asking the USDC judge below to reject the Magistrate's ruling, so the DOJ's request for appellate relief is premature.

one of the appellate judges wanted to let the court below know that he sees an easy PC issue. who knows if the other two appellate judges see it that way.

the presiding judge below, Schiltz, was dealing with his mentally disabled kid when DOJ asked for a quick reversal of the Magistrate judge's decision.

I've had cases where the Mag CLEARLY misstated the law, and the District Judge still followed his ruling by saying that the error was "Harmless".
