Date: September 22nd, 2024 9:35 AM Author: fucking me without a label the agency has been backed up as shit the last two years with cases sitting stagnant for months, which is very unusual. the agency has been known throughout its existence as prompt with its processing of cases, but given all of its lib priorities under the biden admin, there was a massive uptick in cases and they don't have the manpower to process them.
interestingly, though, in the last week alone i have had shit start issuing in cases in multiple regional offices: two complaints/trials set, an investigative subpoena issued, a ruling on a motion to quash a hearing that i filed that was pending before the NLRB in DC. the GC must have issued a directive that cases all start moving fast. maybe the election?
the hearing i have this week is a representation case hearing (election). the petition just got filed last monday, but they schedule hearings 8 days after and it's hard to move them, and it's impossible to move them more than 3 days. i'm going to try to slow walk the hearing (ask my witnesses to go line by line through like 26 job descriptions) to cause delay.
btw, in the two cases where i had complaints issued, i am filing in district ct for injunctions due to the NLRB being unconstitutional. three Tx judges have agreed with that argument. the 5th Circuit is going to affirm, because it already found that the SEC's judges are unconstitutional (in the Jarkesy case), which is one of the issues raised in the cases attacking the NLRB. the NLRB is dun here. i have no idea what my career is going to look like in 2-3 years. |

i have one charge pending in region 5 (baltimore/DC) that has been sitting for over two years now. unheard of. |

they fired 3 people who COINCIDENTALLY happened to be huge U supporters....two days before the election.
they won by just guess. two votes. meaning if the three had been there and voted, the union would have won.
union filed a charge. i got an evidence letter last august or september. 8-9 months, for a fucking evidence letter, lmao.
so that should tell you how things are. like you said, even routine shit a few years ago was dealt with in about a month, although i've had them go a bit longer. but the highest priority case i can think of and the region sat on that shit for months doing nothing.
i happen to know the board agent and he's lazy. but still. |
