-I have yet to ever see a doctor with a trophy wife, its much more of law/finance thing, and even there the vast majority of people don't have trophy wives. I am friends with 3 docs, one is married to a med school class mate, another is married to a lawyer, and the other is single. |

re: Assembly Resolution 1204
Members of the Assembly,
The Student-Wide Judiciary (âSWJâ), having reviewed Resolution 1204 in its entirety, takes issue with several of the proposed changes in the substance of the resolution, as well as with the language within a bill designed, in part, by the Elections and Credentials committee in an attempt to gain power at the outset of an election in which the committee chairman is a candidate for Executive Board president. To be clear, while we do not doubt the integrity of any members on the committee, we maintain that the election season is the wrong time to make changes in the electoral system. Further, as the body charged with resolving all disputes arising from student elections , in opposing the resolution we hope to preempt any claims of foul-play. It is in the studentsâ best interest to have an election free from doubts cast upon its legitimacy. In what follows, we highlight our specific complaints with the proposed resolution, as well as clarify our role within the Universityâs student government structure.
ââ¦this clause puts far too much power in SWJ, which is a body entirely unaccountable to the Student Associationâ¦.While the presence of an offense may be marring to the record of the candidateâ¦[s]uch offenses should be borne in mind when considering the weight or quality, rather than the admissibility of the candidate. In short, it should be the voters who are trustedâ¦rather than the Justices.â[Res. 1204]
The SWJembraces its role as an independent body, separate from the politicized wings of the Student Association (âSAâ). As an independent branch of the SA, with no allegiance to the governing party or any individuals within the SA (and, more broadly, the university community), the SWJ is the appropriate entity for ruling on the legitimacy of any potential candidate running to represent the student body on the SA Executive Board. While we have the utmost faith in the undergraduate community to choose the best qualified among us to serve on the Executive Board,it is not always the case that those undeserving to represent the student body do not petition for office.The SWJ does not disqualify potential candidates on the basis of age, race, color, religion, sex, sexual orientation, veteran status, or national origin. What is important to the SWJ is that the student has maintained conduct befitting the office they wish to hold and that the student has completed all community service hoursissued by the SWJ for prior offenses.
The claim that the SWJ has engaged in a âmasturbatory exercise of powerâ (Res. 1204) is wholly unsupported. The Judiciary follows a line of clearly established precedent, with origins in both the Student Association Constitution and SWJ Rules of Procedure.
âThe judicial authority of the Student Association shall be vested in the Student-Wide Judiciary. It shall have the powers to subpoena, to adjudicate, and to impose penalties, subject to any limitations contained in this Constitution, the Student Association, By-Laws or any rules and regulations duly passed by the Senate and Assembly or the Emergency Powers Council.â

âAll students and all student clubs, organization and governments derived of that student body, of the State University of New York at Buffalo charged with violating any non-academic University regulation not specifically excluded by other statutory regulations or any state law or regulation shall be subject to the jurisdiction of the Student-Wide Judiciary and to the procedures and sanctions herein.â

âThe SWJ Hearing Panel process is used as a source of appeal for SWJ cases, student government disputes (including elections), and any other student appeal where the Division of Student Affairs determines that SWJ maintains jurisdiction.â
(Section 15, IV, SWJ Rules of Procedure)
âThe last election very clearly demonstrated how slow the Student-Wide Judiciary can be to act. Granting Elections and Credentials the power [â¦] will ensure that further violations will not occur during the bureaucratic void that is involved with the dealing with the Student-Wide Judiciary. The presence of review by the Student-Wide Judiciary will, in the end, prevent abuse of this power by the Elections and Credentials Committee.â [Res. 1204]
While any honest person acknowledges that no system is without flaws, we respectfully disagree with the notion that SWJ acts with anything short of expediency â to the best of any college studentâs ability. That is to say, we all work around class schedules; candidates, staffers, elections and credentials committee members, and justices all strive to maintain balance between academic work and extracurricular activity. We appreciate the acknowledgment, in the last clause above, that SWJ exists, in part, to maintain the checks-and-balances system within the student government. That understanding, however, does not always appear elsewhere in the proposed resolution.
âIf staff violate any [â¦] rules and regulations, the candidate, party and/or supporter may receive sanctions. Justification: This allows Elections and Credentials to punish individual violators of Elections Rules and Regulations as well as candidates.Often supporters are able to freely commit violations of rules in this document without fear of any consequences upon themselves.â [Res. 1204]
The SWJ, being the only authority on campus authorized by the University to deliver sanctions, has â since the establishment of the Judiciary in 1973 â been charged with the handling of violations of rules relating to SA elections. While we appreciate Elections and Credentials wishing to lighten our work load, we maintain that this is our jurisdiction â as granted by the Division of Student Affairs. Traditionally, it has been the role of Elections and Credentials to work in conjunction with SWJ, serving as watchdogs on the campaign floor, as well as across the University, and deciding whether petty cases have enough merit to reach our hearing panel. This is a relationship which has, year after year, been shown to work. Although some offenses committed during the election season by candidates and their staffers are minor, there are unfortunate cases occurring each cycle in which more serious claims (such as, but not limited to, stalking and harassment) are alleged. These accusations, being of great concern, need always to be handled by the SWJ (as, again, we are the only body on campus authorized to dispense sanctions with any authority). The SWJ requests nothing more than the following of long-established precedent and the continuation of a process which is streamlined such that all well-documented violations get a fair review from non-partisan and disinterested SWJ Justices.
We strongly urge the Assembly not to pass Resolution 1204. As we understand several of the proposed changes to be in the best interest of the Election and Credentials committee going forward, and not claiming first-person knowledge as to what is in their best interest, we welcome a proposalwithout encroachment on our responsibilities.
