I knew a dood who failed NY with a 143, but that was scaled. I think they told us during bar review that they'd never heard of anyone failing with a 140 raw score.
I'd suspect it's pretty hard to fail with a 140+ scaled score as well. (the dood I knew was in the hospital all of July and literally didn't study NY material at all)

look at the posted july 2011 essays and then tell me. they cannot make one administration harder (in terms of grading) than another -- that's inherently unfair. you just see lower passage rates because most feb takers are foreigners/repeaters as opposed to july folks who are mainly 1st time takers.
