at least I think it falls under that category. I quit a job and filed for unemployment insurance, but got my claim denied. I appealed the decision and wrote the office a long screed about why I quit my job (it was basically a pyriamid scheme consumer scam shop). I will have a hearing in a few weeks, in which the burden of proof is on me to prove that I had good cause for leaving my prior job. However the employer also received a copy of my statements to the unemployment office where I called them out as a scam. In the mail today I received a packet where my old employer sent me copies of my employee agreement of non disclosure, in which I had signed saying I will not discuss the operations of the company that is unknown in the realm of public information. This is them telling me to zip it and not tell the appeal court about why their organization is a scam, but I need to prove that they are a scam in order to collect unemployment and prove I had good reason to leave my job.

Advice? Can they even use a non-disclosure agreement in this instance?

a good reason like you are being sexually harassed by your boss. Not that your company is a shitty multi level marketing scam like every other.

also they dont handle contested unemployment claims in biglaw.

I'm implying you would have input on whether a non disclosure is admissible in this case or not.

that's an example of voluntary disclosure by someone. in my case, I have an obligation to tell the department of workforce development my real reason for resignation.

Sounds like a clause that might be unenforceable because it is contrary to public policy.

I dunno. Do some research.

What earl said. LOL at some herniated asshole admin judge wanting to entertain your self-righteous blubbering. They won't want to touch the NDA and this shit is not set up to protect people who quit companies because they don't like them or they're shitty.
