Possibly. This is close to my prediction of 6-3 (Roberts writing). My only thought is that Roberts will not pass on the opportunity to write the majority opinion in such an important case. If he agrees with the outcome, he will assert his power as CJ to write the opinion, even if it means compromising on some details.
