2) A contract is formed when there is an offer (a manifestation to enter into a valid contract by one party), acceptance that indicates a commitment to be bound, adequate consideration or bargained for legal detriment, and no defenses to formation that would invalidate an otherwise valid contract. |

Because law professors are mostly humanities majors who couldn't find a real job and went to law school, and then couldn't handle the practice of law, and are now writing like the humanities majors they are? 3. Because every law school has too many journals in order to give participation ribbons to their law students, so they have to fill them with something? There are a lot of other reasons. |

Date: July 23rd, 2014 11:31 PM Author: boyish field coffee pot depends on the state and how rigorously they instruct them to stick to the model answers, but usually shit that is completely wrong only hurts you in the sense that it's wasted space and will lead you to make other useless statements and analysis that won't score points. i haven't heard of a state actively dinging you for wrong answers, and stuff generally doesn't need to be verbatim so long as it's the widely accepted definition and understandable as such. shit like the definition of hearsay or whatever has a fairly well recognized sequence of words that they want to see. for the exact set of scenarios used to lay the foundation of expert testimony, they don't need to hear the barbri/kaplan/themis/whatever word-for-word definition because they're all different and nobody cares. i dont think ill completely blank on law or discuss the wrong issue, but i doubt ill be able to memorize and repeat the elements of negligent misrepresentation perfectly on exam day if that issue comes up, even though ill probably be able to string together the major aspects of it. |

Date: July 23rd, 2014 11:40 PM Author: boyish field coffee pot that's usually enough. major thing for the essays is effectively spotting the issues and being able to hit the big points. look at sample essay answers and grading sheets a lot. the graders have mostly the same shit sitting in front of them. how hard they will grade the essay varies a lot, obviously, but look at it from their perspective. take a grading sheet and grade your own essay and you'll see what i mean.
like i said, mistaking issues just fucks you because then you waste time and space on something that won't score you points. you can't outline dump on essays, but once you know what you're discussing, you're basically just shitting out whatever blackletter you can and then common sense analysis. |
