I got around 75% on this MBE thread. As to essays, I also missed some issues:

1. Didn't notice that there was no enforceable contract, I think he paid the purchase price so there was a contract. This is what I have in my outline: "Goods-Paid-For: K for sale of goods enforceable if payment has been accepted or if the goods have been received and accepted." Anyways, I was also writing about ROL (just as everybody).

2. I might have mixed up something in the evidence section, I remember I was writing about the character evidence and general rule, but I remember I was feeling quite insecure about it.

3. I was so stupid that i wrote res ipsa loquitur. I mentioned rules to premises liability in New York, but have no idea WHY i put res ipsa loquitur?!?!?! Here I have def wrong.

4. OK. Didn't know about the automatic stay order either though. Don't know anybody who knew it.

5. OK

I hope we passed. We only need to have 5's on each essay so I hope this will be sufficient.

There was an enforceable contract (full payment of the contract price), but it was discharged due to impossibility. ROL matters here, because the contract would not be discharged if ROL passed.

Yeah, I didn't write about the signature either. The essays were not super easy, I think they were just as hard as in previous years.

As to grading, you need to get around 4.1 raw to have scaled 5s, which means you have to be in top 80% on average. I am quite sure we're not the only ones who missed some issues.

I don't know exactly how hard it is to get 4 points, but from what you are saying, I can't imagine that you did worse than 80%. Even on the first essay, you will get some points for the first answer, and, honestly, I think ROL was quite important here, so if your friend did not mention this, then you most likely will get more points for this question than him.

Also, if you have 70% raw on the MBE then you are aiming at 150+ scaled (provided you didn't bomb the other questions).

Why wasn't there a k? I thought there was one because the good was unique and paid for in full. S is a merchant so ROL passed to B when piano was made available for pick up. S had no duty to store piano for her because it was above and beyond requirement that was not bargained for (no additional consideration) or part of the original agreement. And pick up time wasn't reasonable. I vaguely remember SOF creeping into my answer. That's 100% wrong? Fuck.

I read that essay scale is keyed to the MBE. Hope the national average is high like most July exams because if it's sub-140 the pass rate will be brutal... which is why February pass rates are so low.

no i'm certain i reached the end of the test and circled my answers in the test booklet but can't remember if i finished bubbling. my strategy going in was always to just ID my first choice, limit to 2 answers, and go with my first choice if it was one of the two. i went straight through without leaving blanks. that completely fell apart on the AM section when i started second guessing myself. it was also like 50 degrees in the testing room.

i do remember switching back to my plan during PM and specifically checking every 10 or so bubbles after i was done. i definitely answered all 100 in the PM.
