That way you know you still have to prepare something for the motion but it's going to get blown the fuck off: "We'll, we're all here and ready to go. May as well just do it." Had that happen a few times.

I liked state court better, in NYS at least. Much more wild west, meaning you can pull more tricks. Plus I liked NY brief-adavit style writing better than dry-ass federal style. Plus the court appearances (at least at supreme level commercial div) are much more down to earth and not as pompous.

Never been in NY state court so I can't comment whether it is prole or not. But here it is just a giant clusterfuck. The judges dont do shit and just endorse whatever the stupid research atty advises. And the research atty has a billion things on her plate and usually went to a true TTT. You go to the appearance to argue a MSJ or whatever and the judge hasn't even looked at the papers yet. It's such a joke and the complete opposite of most fed district courts which are run like well oiled machines.

Delaware doesn't count. The judges there are better than a lot of fed dist court judges.

And at any rate just because sophisticated shit gets filed doesn't mean anything. Tons of sophisticated shit gets filed in Los Angeles or San Fran but at least 50% of the judges there suck balls and at any rate have way too big of a caseload to spend the time required to understand a complex case.

No. You don't need to be anywhere close to perfect to practice in fed court. Fed court is best if you want stuff you file to be fairly considered by someone who is smart so that you can reliably tell a client what will likely happen. State court is good if your case is a dog and the only way you will survive long enough to force a settlement is if the judge renders incompetent decisions.
