my old firm did this. it is a way to pass 401k testing from the irs or some shit. the bullshit thing though was that the 3% came from our base salary. so instead of 160 we earned 155 or so with 5 going to the 401k.

That's because there are rules against 401k plans favoring people that make a lit of money. Its common for fairly common for firms to do a 3% safe-harbor contribution.

downsides:

-3k hours/years

-you probably gotta live in Texas (mainly Houston); Seattle is an OK office; the LA/NY offices are too small

-partners there don't make that much

-they overrate clerkships and it causes their talent to suffer; a T6 honors grad who forgoes a clerkship won't get hired, but a UHouston grad who got a SD Tex clerkship will get hired
