I gave up a long time ago trying to civilize the idiots at this firm. If I ever change any of their shitlaw language they immediately are like "where's the COMES NOW?" and "not enough thereafters, whereafters, etc." They ruin every brief with that shitlaw garbage. It's like they can't handle just a nice simple brief. Gotta muck it up.

i think he's 100% right about that. nothing more distracting than a stringcite. and it's hard to tell where sentences begin with parentheticals.

stringcites are not at all distracting. anyone who reads a lot of briefs knows instinctively when to glance & skip over string cites and when it might be useful. what WOULD be distracting is having to fucking look down at the bottom of the page to look at a footnote just to see whether there's anything except a cite, and to see what is cited, etc. it would ruin the whole flow of reading.

the cites themselves can often be important. in general i think anyone who is inquisitive is going to want to look down to see what is in the footnote. that's my point. having to look to a separate part of the page is more distracting than having to skip over a cite.

This. In most situations, especially at the trial court leave

, the cite following a sentence is often more important than the sentence itself. Forcing the reader to go to the bottom of the page would be bad form.

His footnote recommendation is inconsistent with the trend of old judges reading briefs on screens. They usually don't use a full-page view. They scroll down continuously. Footnotes are either a pain in the ass or they're ignored.

they should be ignored. if it's important enough, put it in the body. a footnote should be there for backup only. there's no reason a reporter cite needs to be in the main line. and case names are only important for cases that people know.

This is the opinion of someone who is either too in love with their own writing or doesn't know a god damn thing about practicing law. Here's a hint: trial court judges don't give a fuck about what you have to say about the law. They care what the court of appeals will do and that's it.

what? he's exactly right.

it's much better to say "x informed y and thus y avoids liability; in smith mr z avoided the sec (1), in johnson mr. d avoided conviction (2), and likewise in gomez mr. f escaped waiving privilege (3)."

that's far better than stringcites, and only eschewed if your argument is sps.

Except in your shitty footnote style the judge doesn't know whether those three cases were decided by the dumbfuck magistrate in Shitsville or SCOTUS, unless he looks at the footnote. He doesn't know if they were recent cases or from the 1920s. He doesn't know if they're published or not, and thus precedential or not. And trying to cram all that info into the text is ridiculous. Citation formats exist precisely because they can convey a large amount of information in a succinct way. To hide that from the decisionmaker (unless he is willing to break reading to scroll down) is terrible form and preferred mostly by academics who care more about what they have to say than what any authority says.
